The Department of Defense has access to extraordinary AI capabilities through its own research programmes, through DARPA, through decades of investment in defence-sector technology companies. What it does not have – and what no amount of internal development can manufacture – is a credible safety story to tell Congress as binding AI legislation approaches. The Regulatory Timeline Makes the Deal’s Purpose Obvious
Congress has been working on AI regulation with unusual bipartisan urgency. The AI Safety framework discussions, the Senate AI caucus hearings, the European AI Act’s extraterritorial provisions pressuring US companies – all of this creates a political context in which the Pentagon needs a defensible answer to the question: how does the US military use AI responsibly? An internal answer is easily challenged. An answer that involves OpenAI – the company that pioneered AI safety as a concept, that built the most publicly recognised safety team in the industry – is structurally harder to attack.
As Business Insider reported, the fallout over OpenAI’s Pentagon deal has been growing since the agreement was announced. But the criticism has been directed primarily at OpenAI. The Pentagon has largely avoided accountability for the deal’s terms, despite being the party that demanded language allowing any lawful use while refusing to include explicit prohibitions on domestic surveillance. That asymmetry is not accidental – it is exactly what the Pentagon purchased.
OpenAI CEO Sam Altman framed this explicitly when he said the company’s refusal to walk away would prevent a scary precedent of government agencies operating without safety-conscious AI partners. In doing so, it provided the Defense Department with a ready-made response to any congressional critic: the military is working with the leading AI safety company in the world, which has endorsed the arrangement. Why OpenAI’s Safety Brand Is Uniquely Valuable to the DoD
The value of OpenAI’s safety narrative to the Pentagon is not abstract. It is specific and operational. The company published a detailed Preparedness Framework, operates a safety team that has testified before Congress, and built ChatGPT into a product that hundreds of millions of people associate with responsible AI development. That recognition – earned through years of public positioning – is what makes OpenAI useful as a regulatory shield in ways that, say, Palantir or Anduril cannot replicate. Those companies are unambiguously defence contractors. OpenAI is, in the public mind, the company that worries about AI risk.
The Verge’s reporting on the deal’s actual terms makes clear how the safety narrative operates as cover. The key phrase in the agreement is any lawful use. U.S. intelligence agencies have a well-documented history of defining lawful expansively – the NSA’s bulk metadata collection, the FBI’s use of FISA warrants, the domestic surveillance programmes revealed by Edward Snowden were all, in the government’s view, lawful at the time they operated. An OpenAI safety team that endorses an any lawful use standard is not constraining the Pentagon. It is legitimising whatever the Pentagon’s lawyers decide to authorise.
Sam Altman’s own post-deal admission is revealing. He told staff the backlash was really painful, according to the Wall Street Journal, but defended the Pentagon work on the grounds that employees do not get to weigh in on operational military decisions. That framing – safety team cannot constrain military use – is precisely what makes OpenAI’s safety narrative valuable to the DoD. It provides the imprimatur without the actual restriction.
The Pattern Across Other DoD Technology Acquisitions
This pattern is not new in defence procurement. When the Pentagon acquires technology from companies with strong public credibility – Amazon Web Services for the JEDI cloud contract, Google for Project Maven image recognition – it gains both the capability and the implicit legitimacy of the company’s civilian reputation. Project Maven created exactly the same dynamic: Google employees protested, the company eventually declined to renew, but the reputational legitimacy provided by even a brief Google imprimatur shaped how the programme was publicly discussed while it ran.
OpenAI’s arrangement is designed to be more durable than Project Maven precisely because Altman, unlike Google’s leadership at the time, chose to stay rather than walk away. The safety narrative is now embedded in an active, ongoing contract rather than a cancelled one. Business Insider reported the deal is still being actively defended and extended even as criticism grows. The longer it runs with OpenAI’s name attached, the more entrenched the regulatory legitimacy becomes.
What This Actually Means
What the Pentagon bought with its OpenAI deal is not a technology advantage – it is a regulatory advantage. With OpenAI’s safety brand embedded in its AI procurement, the DoD now has a significantly easier time arguing to Congress, to allied governments, and to the public that it is using AI responsibly. Every safety concern raised about military AI can be answered with reference to OpenAI’s published frameworks, its safety team’s congressional testimony, and its well-known red lines – even though those red lines are not contractually binding and the safety team cannot constrain military operational decisions.
That is an extraordinarily valuable acquisition. The Pentagon understood this. Altman, who admitted the deal looked opportunistic and sloppy, understood it too – and signed it anyway. The technology transfer is secondary. What changed hands was the permission structure: the US military now has the AI safety industry’s most credible name attached to whatever it decides to do next with artificial intelligence.
